Terms of Sale

​

1. Payment:

  • Payment is due within 30 days of the invoice date (Net 30).

  • Accepted methods of payment are: Credit card, and PayPal.

  • Failure to remit payment within 30 days may result in a late payment fee of 1.75% per week on the outstanding balance.

  • Continued failure to pay may result in the suspension of services and/or further legal action, including arbitration and potential court proceedings, to recover the debt. The Client shall be responsible for all costs and fees associated with such recovery efforts, including attorney fees.

2. On-Site Responsibility and Insurance:

  • The Client is solely responsible for the safety and security of their property, personnel, and equipment while on-site.

  • Any damage to the property, injury to personnel, or harm to equipment occurring on-site during the course of Moments in Photography LLC's work shall be the sole responsibility of the Client.

  • The Client agrees to indemnify and hold harmless Moments in Photography LLC from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorney fees) arising from or relating 1 to any such damage, injury, or harm, except to the extent such damage, injury, or harm is caused by the negligence of Moments in Photography LLC.   

  • Moments in Photography LLC maintains liability insurance to cover damages that may occur as a direct result of our photography sessions. However, the Client remains primarily responsible for ensuring the safety and security of their own property, personnel, and equipment.

  • The Client shall be responsible for the full cost of restoring any damaged property, equipment, or for reimbursing any associated medical expenses incurred by personnel on-site, except to the extent such damage, injury, or harm is caused by the negligence of Moments in Photography LLC.

3. General Terms:

  • These Terms of Sale constitute the entire agreement between the Client and Moments in Photography LLC with respect to the services provided and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

  • Moments in Photography LLC reserves the right to amend these Terms of Sale at any time.

  • These Terms of Sale shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.​​
